Jose Rojas considers suing Botafogo after failed transfer

The Brazilian club claim an undiagnosed heart problem was the reason for their withdrawal, an assertion fiercely disputed by the player and his representative

The agent of Universidad de Chile defender Jose Rojas has stated that his client is considering legal action against Botafogo, dismissing a supposed medical issue which the Brazilians claim led to the collapse of the player's move to Rio de Janeiro.

The 28-year-old, who captained the Azul to three titles in 2011 including the Copa Sudamericana, had agreed a permanent switch to Botafogo, only to see his hopes of playing in Brazil fall apart during the medical.

Club doctors revealed that the player had a previously undetected heart condition, causing the Fogao to withdraw their interest.

Speaking on Thursday, however, representative Mauricio Valenzuela categorically rejected the medics' assertions and affirmed that a lawsuit for breach of promise was not out of the question.

"It is a subject that we will have to analyse in depth alongside 'Pepe' [Rojas]. Thanks to God, all of the medical exams he underwent in Chile showed that he was perfectly healthy to play football," the agent told Radio Cooperativa.

"I believe the case merits further investigation, to see if we will start legal action against Botafogo. We are upset because the exams were not carried out properly. Naturally, we feel mistreated by a rushed and poorly judged decision on the part of Botafogo."

Rojas made his debut for Universidad in 2003, and aside from a six-month loan spell with Independiente during the 2006 Clausura has played his entire career for the Santiago giants.
